Section 154 rectifies a mistake apparent from the record — TDS credit not given, an arithmetic error, an unmatched challan. It does not reach debatable questions, which need an appeal. Apply generally within four years from the end of the financial year in which the order was passed; the authority is to decide within six months from the end of the month of receipt.
What is this notice?
A rectification under Section 154 fixes something that is plainly wrong on the face of the record, most often in an intimation under Section 143(1). It is not a route to re-argue the assessment: a point needing reasoning, evidence or two possible views is not a mistake apparent from the record and belongs in appeal under Section 246A.
Common reasons it is issued
- TDS credit reflected in Form 26AS but not allowed in the intimation
- Advance tax or self-assessment tax paid but not matched to the challan
- Arithmetical error in computing income, interest or the refund
- A submission actually on record having been overlooked
- Relief under Section 89 or a deduction claimed in the return not given effect
How to reply — step by step
- Identify the mistake precisely and show it from the record itself — the return, the intimation, Form 26AS, the challan. A rectification succeeds or fails on being obvious.
- Choose the right remedy. If the point needs argument or fresh evidence, file an appeal; a rectification application does not extend the appeal period, and time lost this way is rarely recoverable.
- File online against the correct order — rectification of an intimation and of an assessment order are separate requests, and are frequently filed against the wrong one.
- Attach the proof in the form the system expects, with the challan and deductor details where credit is in issue.
- Where the rectification is refused or not disposed of, remember that an order under Section 154 is itself appealable.
